General Terms and Conditions<\/b><\/p>

\u00a7 1 Scope, Definitions<\/b> (1) The company Terra & Tree, Wasserhofstra\u00dfe 47, 60599 Frankfurt am Main, Germany (hereinafter: “we” or “Terra & Tree”) operates an online shop for the sale of goods on the website https:\/\/www.terra-tree.com<\/a>. The following general terms and conditions apply to all services and provisions between us and our customers (hereinafter: “customer” or “You”) in the version valid at the time of the order, unless expressly agreed otherwise. (2) A “consumer” within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An “entrepreneur” is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.<\/p>

\u00a7 2 Conclusion of Contracts, Storage of Contract Text<\/b> (1) The following regulations regarding the conclusion of contracts apply to orders placed through our online shop at https:\/\/www.terra-tree.com<\/a>. (2) Our product presentations online are non-binding and do not constitute a binding offer to conclude a contract. (3) When an order is received in our online shop, the following regulations apply: The customer submits a binding offer to conclude a contract by successfully completing the order process provided in our online shop. The order is placed in the following steps:<\/p>

  1. Selection of the desired goods,<\/p><\/li>

  2. Adding products by clicking the corresponding button (e.g., “Add to cart”),<\/p><\/li>

  3. Checking the details in the shopping cart,<\/p><\/li>

  4. Proceeding to the order overview by clicking the corresponding button (e.g., “Proceed to checkout”),<\/p><\/li>

  5. Entering\/checking address and contact details, selecting the payment method, confirming the General Terms and Conditions (GTC), and completing the order by clicking the “Buy now” button (Order with obligation to pay). This constitutes your binding order. The contract is concluded when you receive an order confirmation from us at the specified e-mail address within three business days. <\/p><\/li><\/ol>

    (4) In the event of a contract conclusion, the contract is concluded with Terra & Tree, Wasserhofstra\u00dfe 47, 60599 Frankfurt am Main, Germany. (6) Before placing the order, the contract data can be printed or saved electronically using the browser’s print function. The order processing and the transmission of all necessary information regarding the conclusion of the contract take place via e-mail after you have submitted your order, partly automated. We do not store the contract text after its conclusion. (7) Input errors can be corrected using the usual keyboard, mouse, and browser functions (e.g., the browser’s “Back” button). They can also be corrected by prematurely canceling the order process, closing the browser window, and repeating the process. (8) The order processing and the transmission of all necessary information in connection with the conclusion of the contract take place via e-mail, partly automated. Therefore, you must ensure that the e-mail address you have provided to us is correct, that the receipt of e-mails is technically ensured, and, in particular, that it is not prevented by spam filters. <\/p>

    \u00a7 3 Subject Matter of the Contract and Main Characteristics of the Products<\/b> (1) In our online shop, the subject matter of the contract is: The sale of goods (olive oil). You can view the specific goods offered on our product pages. (2) The essential characteristics of the goods are stated in the product description. If the agreed quality of the goods deviates from their usual quality and conditions of use, this is expressly indicated in the product description (negative quality\/deviation agreement). If the customer has given their express consent to the negative quality deviation, this determines the subject matter of the contract. <\/p>

    \u00a7 4 Prices, Shipping Costs, and Delivery<\/b> (1) The prices stated in the respective offers, as well as the shipping costs, are final prices and include all price components, including all applicable taxes. (2) The respective purchase price must be paid before the delivery of the product (prepayment), unless we expressly offer purchase on account. The available payment methods are displayed under a correspondingly labeled button in the online shop or in the respective offer. Unless otherwise specified for individual payment methods, payment claims are due and payable immediately. (3) In addition to the stated prices, shipping costs may arise for the delivery of the products, unless the respective product is marked as free shipping. The shipping costs will be clearly communicated to you in the offers, possibly in the shopping cart system, and in the order overview. (4) All offered products, unless clearly stated otherwise in the product description, are immediately ready for dispatch (delivery time: 1-3 business days after receipt of payment). (5) The following delivery area restrictions apply: Delivery is made to the following countries: Germany, Greece. (6) If the delivery of the goods fails for reasons for which you are responsible, you will bear the reasonable costs incurred by us as a result. This does not apply to the costs of initial shipping if you validly exercise your right of withdrawal. For the return costs in the event of a valid exercise of your right of withdrawal, the regulation provided in the withdrawal information applies. <\/p>

    \u00a7 5 Right of Retention, Retention of Title<\/b> (1) You may exercise a right of retention only insofar as it concerns claims from the same contractual relationship. (2) The goods remain our property until full payment of the purchase price. <\/p>

    \u00a7 7 Language of the Contract<\/b> The German language is exclusively available as the contract language.<\/p>

    \u00a7 8 Liability<\/b> (1) Subject to the exceptions below, our liability for contractual breaches of duty as well as for tort is limited to intent or gross negligence. (2) In the event of slight negligence, we are liable without limitation in case of injury to life, body, health, or in case of breach of an essential contractual obligation (fundamental obligation). If we are in default of performance due to slight negligence, if performance has become impossible, or if we have breached an essential contractual obligation, liability for property damage and financial losses resulting therefrom is limited to the typical foreseeable damage for the contract. <\/p>

    \u00a7 9 Warranty \/ Liability for Defects<\/b> (1) Warranty and liability for defects are governed by statutory provisions. (2) For entrepreneurs, the limitation period for claims due to defects in delivered goods is 12 months. (3) As a consumer, please check the goods immediately after the conclusion of the contract for completeness, obvious defects, and transport damage and notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory claims for defects. <\/p>

    \u00a7 10 Final Provisions \/ Dispute Resolution<\/b> (1) German law applies. For consumers, this choice applies only to the extent that they are not deprived of the protection afforded to them by the mandatory provisions of the law of the state of their habitual residence (principle of the most favorable regulation). (2) The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) are expressly excluded and do not apply. (3) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider’s registered office. (4) We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. <\/p>
